§ 34-201. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Abandoned vehicle means one which:

    (1)

    Is inoperable and more than five years old and left unattended on public property for a period of more than 48 hours;

    (2)

    Has remained illegally on public property for more than 48 hours;

    (3)

    Has remained on private property without the consent of the owner or person in control of the property for more than 48 hours; or

    (4)

    Has been left unattended on the right-of-way of a designated city, county, state or federal highway within this city for more than 48 hours or more than 24 hours on a turnpike or a controlled access highway, as defined by V.T.C.A., Transportation Code § 541.302, Uniform Act Regulating Traffic on Highways.

    Antique auto means a passenger car or truck that is at least 35 years old.

    Collector means the owner of one or more antique or special interest vehicles who collects, purchases, acquires, trades or disposes of special interest or antique vehicles or parts of such vehicles for personal use in order to restore, preserve and maintain an antique or special interest vehicle for historic interest.

    Garagekeeper means an owner or operator of a parking place or establishment, motor vehicle storage facility, or establishment for the servicing, repair or maintenance of a motor vehicle.

    Inoperable motor vehicle means a motor vehicle that does not have lawfully affixed to it either an unexpired license plate or a valid motor vehicle safety inspection certificate, or a vehicle that is not in operating condition because it is wrecked, dismantled, partially dismantled or has one or more flat tires.

    Junked vehicle shall have the same meaning as provided by V.T.C.A., Transportation Code § 683.071, and any amendments thereto and as currently defined as:

    A "junked vehicle" means a vehicle that is self-propelled and does not have lawfully attached to it:

    (1)

    An unexpired license plate; or

    (2)

    A valid motor vehicle inspection certificate; and

    (3)

    Is:

    a.

    Wrecked, dismantled or partially dismantled, or discarded; or

    b.

    Inoperable and has remained inoperable for more than:

    1.

    Seventy-two consecutive hours, if the vehicle is on public property; or

    2.

    Thirty consecutive days, if the vehicle is on private property.

    Motor vehicle means a motor vehicle subject to registration under the Certificate of Title Act, V.T.C.A., Transportation Code § 501.002, and additionally includes a motorboat, outboard motor, or vessel subject to registration under V.T.C.A., Parks and Wildlife Code ch. 31 and also additionally including airplanes.

    Special interest vehicle means a motor vehicle of any age that has not been altered or modified from original manufacturer's specifications and, because of its historic interest, is being preserved by hobbyists.

    Storage facility means a garage, parking lot, or any type of facility or establishment for the servicing, repairing, storing or parking of motor vehicles.
