§ 46-36. Parental responsibility.

  • (a)

    Contributing to the neglect or delinquency of minors. A parent, guardian or other person having the care, custody or control of a minor commits an offense if, by any act or omission, or by lack of supervision and control over such minor, he encourages, contributes toward, causes or tends to cause the minor to become neglected or delinquent.

    (b)

    Defenses . It is a defense to prosecution under subsection (a) of this section that the minor is married, or had been married, or had disabilities of minority removed in accordance with Texas Family Chapter 31, as amended.

    (c)

    Penalty for violation of section . A person who violates a provision of this section is guilty of a separate offense for each day or part of a day during which the violation is committed, continued or permitted. Each offense is punishable by a fine not to exceed $500.00.
