§ 90-59. Grant of franchise.

No franchise shall be granted except when the franchise shall be authorized by ordinance passed by the council after compliance by the applicant with the provisions of this article; provided that no franchise shall ever be granted unless the council finds a public necessity exists for the service and that the applicant is, in the opinion of the council, capable of rendering such service.
